Standard & Testamentary Wills

We can help you setup stand wills & testamentary trust wills. We can also provide advice on which type of will is best for your circumstances.

Estate Planning

Whether you have a small estate or a large estate with different business structures and numerous assets. We can discuss and plan every detail including life insurance, Superannuation and even tax implications.

Estate Administration

Once the Will & Estate plan are active, we will carry out your plan and ensure your loved ones are looked after the way you wanted.

Probate

If you are the executor of a Will, we can help you apply for probate. So the will can be validated and ownership of the assets can be transferred.

Intestacy

In situations where there isn't a valid will, or only a partially valid will, intestacy may occur. In these situations we can help relatives to apply for "Letters of Administration" to get the authority to distribute assets in accordance to the law.

Legal Capacity

We can help in all Legal Capacity cases. Where an assessment of someones ability to make legal decisions including making a will is in question.

When Do I Need To Create or Update My Will?

Our general advice is to start thinking about your final wishes from the age of 18, even if you have very little assets. Get your will done by a legal professional to avoid costly issues arising in the future. Then we recommend you review your will every 2 -3 years, or when your circumstances change, for example:

You've started or bought a business

You bought a house or land

You have started a family and now have a child or children

If your named executors / trustee of your will dies or is unable to perform the role

The key beneficiaries named in your will changes for some reason

You have divorced or re-married

You have started a Defacto relationship

What Happens When I Don't Create a Will?

If you pass away without creating a valid Will, this is called Intestate. The Intestacy rule means that your assets will be distributed to family members by a default pre-decided formula by the State. However, your relatives can apply for "Letters of Administration" to gain authorisation to distribute your assets. It is a very time consuming and costly process.
